The agreement between you and AI Guru Agent when you use the Service. Please read it before you sign up.
Agreeing to these terms
These Terms of Service ("Terms") govern your use of AI Guru Agent (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
If you use the Service for a company or other organisation, you confirm that you may bind it to these Terms, and "you" means that organisation. You must be at least 18 years old.
The Service
AI Guru Agent lets you build AI chatbots trained on your website, files, text and Q&A answers, put them on your website or share a hosted chat link, capture leads, hand conversations to your team, and see analytics. The features and limits of each plan are shown on our Pricing page.
We improve the Service over time and may add, change or remove features. If a change materially reduces what a paid plan includes, we will tell you in advance.
Your account and team
Give accurate information and keep it up to date.
Keep your login and API tokens secret. You are responsible for everything done in your account, including by teammates you invite and tokens you create.
Tell us straight away through our contact page if you think someone is using your account without permission.
Your content
You keep all rights to the content you add and to your chatbots' conversations. You give us permission to store, process and send it to our providers only as needed to run the Service for you.
Only add websites and files you own or are allowed to use. When we read a website for you, we follow its robots.txt rules.
AI answers and your chatbot
Your chatbot writes answers with AI from your content. AI answers can be incomplete or wrong. You are responsible for what your chatbot tells your visitors: review its answers, add Q&A answers for important questions, and use the answer tests and handoff features where accuracy matters.
Do not rely on your chatbot alone for medical, legal, financial or safety-critical advice. Where the law requires it, tell your visitors that they are talking to an AI.
Your visitors' personal data
For the personal data your chatbot collects from your visitors, you decide what is collected and how long it is kept, and we process it on your behalf. You are responsible for having a lawful basis for that collection and for telling your visitors about it, for example in your own privacy notice.
We process that data only to provide the Service and on your instructions, keep it confidential, use only the providers listed in our Privacy Policy, help you answer your visitors' requests, and delete it when you delete it or your account.
Acceptable use
You agree not to use the Service to:
Break any law, or infringe anyone's intellectual property, privacy or other rights.
Publish or generate content that is deceptive, defamatory, hateful, harassing, sexually exploitative or harmful.
Send spam, or collect personal data that your visitors did not knowingly give you.
Collect payment card numbers, government ID numbers or health data through a chatbot.
Read websites you are not allowed to use, or get around our usage limits, security or access controls.
Disrupt the Service, test its load, or reverse-engineer, resell or copy it without our written permission.
Plans, billing and cancellation
Paid plans are billed in advance, monthly or yearly, in US dollars through our payment provider, plus any taxes that apply. By subscribing you authorise these recurring charges until you cancel.
Each plan includes a number of AI answers per month. When an account has used them all, its chatbots stop answering until the next month, unless you buy a top-up or upgrade. A top-up is valid for the period shown when you buy it.
You can cancel at any time in Billing. Your plan stays active until the end of the period you have paid for, and is then not renewed.
Except where the law requires otherwise, payments already made are not refundable.
We may change our prices. A new price applies to an existing subscription only from its next renewal, and we will tell you before it does.
The Free plan and its limits may change at any time.
Other services
If you connect another service, such as Zapier or your own webhook, that service's own terms apply to it, and we are not responsible for what it does with the data you send it.
Suspension and ending the agreement
You can stop using the Service and delete your account at any time from Settings → Data & privacy. We may suspend or close an account that breaks these Terms, puts the Service or other users at risk, or has unpaid charges. Where possible, we will warn you first and give you a chance to fix the problem and to download your data.
Our rights
We own the Service, including its software and design. These Terms do not give you any rights in it except the right to use it as described here. If you send us ideas or feedback, we may use them without any obligation to you.
Disclaimer
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will be uninterrupted or error-free, or that AI answers will be accurate.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill.
Our total liability for all claims about the Service is limited to the greater of what you paid us for the Service in the 12 months before the claim arose, or US$100.
Nothing in these Terms limits liability that cannot be limited by law.
You will compensate us for claims and costs caused by your content, your chatbot's use with your visitors, or your breach of these Terms or of the law.
Changes to these Terms
We may update these Terms. We publish the new version here with a new effective date and, for significant changes, tell account owners before they take effect. If you keep using the Service after that, the new Terms apply.
Governing law and contact
These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of India have exclusive jurisdiction over any dispute.
